End-User License Agreement

READ THIS AGREEMENT CAREFULLY

This is a legal agreement between you ("You") and Mediamond Tmi ("Mediamond"). By installing, copying, or otherwise using the Deluxe Ski Jump 3 software ("Software"), You agree to be bound by the terms of this agreement. If You do not agree with the terms of this agreement, You may not install or use the Software.
1. DEFINITIONS

a. "Software" means the "Deluxe Ski Jump 3" software product.
b. "You" means the individual or single entity licensing the Software.
c. "Mediamond" means Mediamond Tmi, Finland. Business ID: 1588646-5.
d. "Trial Version" means a demonstration version of the Software with limited functionality.
e. "Full Version" means a commercial version of the Software with full functionality.
f. "Unlocking" means the conversion of the Software from the Trial Version to the Full Version.
g. "Registration Key" means a code number, which can be used to Unlock the Software.
h. "Registered User" means the individual or single entity to which Mediamond has assigned the Registration Key.
i. "Web Hill Records Database" means the web-based collection of personal hill records, which is published by Mediamond.
j. "Online Game" means the multiplayer game mode, which is played over the Internet.

2. INTELLECTUAL PROPERTY

The Software is owned by Mediamond and is protected by copyright and other intellectual property laws and treaties. Mediamond reserves all rights not expressly granted in this license.
3. GRANT OF LICENSE

Mediamond grants You non-exclusive, non-transferable, limited license to use the Software for personal, non-commercial use with the following rights and restrictions:

3.1 LICENSE RIGHTS

a. You may install and execute the Trial Version of the Software on any number of computers.
b. You may Unlock the Software with Your personal Registration Key provided that:
1) You have received the Registration Key from Mediamond
2) You are Unlocking the Software for Your personal, non-commercial use only
3) There are no other copies of the Software Unlocked with the same Registration Key at the same time.
c. You may execute the Full Version of the Software provided that it is Unlocked in accordance with the clause 3.1b.
d. You may submit Your hill records to the Web Hill Records Database provided that:
1) You are a Registered User.
2) You are at least 18 years of age or with parental/guardian consent.
d. You may log onto and use the Online Game provided that:
1) You are a Registered User.
2) You have a valid subscription to the Online Game.
3) You are at least 18 years of age or with parental/guardian consent.
e. You may take backup copies of the Software for Your personal use.
f. You may freely, at no charge, distribute the replay, ski jumper, and team definition files generated by the Software provided that You grant Mediamond non-limited license to use and redistribute them.
g. You may freely, at no charge, distribute the original, unmodified Software installation package.
3.2 LICENSE RESTRICTIONS

a. You may not reverse engineer, decompile, or disassemble the Software or any part of it, except to the extent the foregoing restriction is expressly prohibited by applicable law.
b. You may not modify or create derivative works based upon the Software in whole or in part.
c. You may not copy the Software or any part of it except as expressly permitted in this agreement.
d. You may not sublicense, sell, lease, or rent the Software or any part of it.
e. You may not disclose the Registration Key to any 3rd party by any means.
f. You may not cheat or use exploits to gain competitive advantage over other players.
g. You may not post any foul or offensive language, illegal content, personal information, advertisements, or propaganda to the Online Game chat.

4. SEVERABILITY

Invalidity of any provision of this agreement shall not affect the validity of the remaining portions of this agreement.
5. TERMINATION OF AGREEMENT

Without prejudice to any other rights, Mediamond may terminate this agreement if You fail to comply with the terms and conditions of this agreement. In such case You must immediately destroy all copies of the Software in Your possession.

Mediamond will not refund any fees if the agreement is terminated due to breach of terms and conditions.
6. DISCLAIMER OF WARRANTY

The Software is provided "AS IS" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability or fitness for a particular purpose.
7. LIMITATION OF LIABILITY

In no case shall Mediamond be liable for any damages whatsoever arising out of the use of or inability to use the Software, even if Mediamond has been advised of the possibility of such damages.
8. GOVERNING LAW

This license is governed by the laws of Finland and applicable international agreements, treaties, and conventions.
